DGFT CLEARANCE

HSN 7802 00 10 (Lead scrap) is subject to the ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), under which import of only the specified type of scrap is Free per DGFT Notification 31/2015-20 dated 13-11-2019. Clearance is permitted only at specified ports and locations under Para 2.54 of the Handbook of Procedures, and a Pre-Shipment Inspection Certificate generated through the DGFT online system is mandatory. Hazardous waste management compliance under Rules 11, 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 applies as an additional overlay.

    Obtain a Pre-Shipment Inspection Certificate from a DGFT-recognised Pre-Shipment Inspection Agency. All PSICs must be generated online through the DGFT website; PSICs dated on or after 1 July 2022 not generated through the DGFT online system will not be accepted by Indian Customs. Upload the PSIC in e-Sanchit under document code 856001 before filing the bill of entry.

    Route the consignment only through specified ports and locations notified under Para 2.54 of the Handbook of Procedures. For imports from safe countries or regions through specified ports, the PSIC requirement is waived; for un-shredded scrap (HMS-I and HMS-II), follow the procedure under Para 2.54 of HBP as amended, read with DGFT PN 38/2015-2020 dated 06-10-2016 and corrigendum PN 40/2015-2020 dated 25-10-2016.

    Ensure compliance with Rules 11, 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016, including submission of valid Forms 2, 6, 7 and 9, and compliance with Schedules III, VI and VIII of those Rules. Subject the consignment to the radioactive-contamination SOP under the Annexure to DGFT PN 37/2015-20 dated 15-11-2021, and confirm Para 8(B) of the General Notes of the ITC (HS) import policy is satisfied.

A word of counsel

The most common error on this tariff line is submitting a PSIC generated outside the DGFT online portal — a pre-digital or manually issued certificate issued on or after 1 July 2022 will be rejected at customs out-of-charge, triggering detention and demurrage regardless of the consignment's physical conformity. Importers should also not conflate the safe-country PSIC waiver with an exemption from the specified-port restriction: the port restriction is absolute and a consignment arriving at an unspecified port faces seizure irrespective of country-of-origin status.
