Note that the azo-dye testing exemption applies only to imports originating from the EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea and the United Kingdom; consignments from all other countries must furnish the PSIC without exception.

A word of counsel

The most frequent error on this tariff line is assuming the azo-dye testing exemption is broader than it is. The exemption covers only nine named jurisdictions — EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea and the United Kingdom — and does not extend to any other origin, including countries with bilateral trade arrangements with India. A consignment arriving without a valid PSIC from a non-exempt origin will be detained at the port of entry pending production of conforming documentation, attracting demurrage and ground rent.
