DGFT CLEARANCE

HSN 5702 92 20 (Mats and mattings) is subject to the ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), which requires a Pre-Shipment Inspection Certificate (PSIC) from an accredited laboratory certifying the absence of prohibited hazardous azo dyes. This requirement flows from General Note 10 of the ITC (HS) Import Policy, with an origin-specific exemption for nine named countries.

Compliance steps
  1. 1
Obtain a Pre-Shipment Inspection Certificate from an accredited laboratory of the exporting country, or a valid test report from the Textile Committee or CSRTI, certifying the absence of prohibited hazardous azo dyes. This document must accompany the bill of entry for all origins not listed in the General Note 10 exemption.

  2. 2
Verify the country of origin before shipment: imports from the EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea and the United Kingdom are exempt from azo-dye testing only. The PSIC requirement for other compositional or safety parameters remains in force even for exempt origins.

A word of counsel

The most common error on this tariff line is reading the azo-dye-testing exemption for the nine named countries as a full exemption from the PSIC requirement. The exemption is confined to azo-dye testing only; a PSIC covering other prohibited hazardous dyes and compositional parameters remains mandatory even for EU or Australian origin consignments. Presenting a consignment without the requisite certificate at the bill-of-entry stage results in detention pending documentary rectification.

Frequently asked
Does HSN 5702 92 20 require BIS certification?
No, woven mats and mattings of man-made textile materials are not within the BIS Quality Control Order regime. Import is governed by the ITC (HS) policy administered by the Directorate General of Foreign Trade, principally through the General Note 10 hazardous-dyes PSIC requirement.
Which countries are exempt from azo-dye testing under General Note 10?
Imports from the EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea and the United Kingdom are exempt from azo-dye testing only, per DGFT Public Notice 14/2023 dated 14-06-2023; all other origins must provide a PSIC or valid test report from the Textile Committee or CSRTI.
What happens if the PSIC is missing at the time of filing the bill of entry?
The consignment is liable to detention at the port of import until the PSIC or valid test report is produced; prolonged detention attracts demurrage and ground rent, and continued non-compliance may result in re-export or confiscation under the Customs Act, 1962.
