Of terylene dacron

High tenacity polyester filament yarn of terylene dacron

DGFT CLEARANCE

HSN 5402 20 10 (Of terylene dacron) is subject to ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), requiring a Pre-Shipment Inspection Certificate confirming the absence of prohibited hazardous azo dyes under General Note 10 of the ITC (HS) Import Policy. No additional sectoral PGA licence applies, but failure to produce the PSIC at the bill of entry results in consignment detention.

  2. 2

A word of counsel

The most common error on this tariff line is assuming the azo-dye country exemption extends to goods merely transshipped through an exempt country — the exemption applies to the country of origin, not the country of export or the port of loading. A consignment of terylene dacron yarn manufactured in a non-exempt country and transshipped via an EU hub still requires a full PSIC; presenting the transshipment bill of lading as proof of EU origin will result in detention and a DGFT policy contravention.

Frequently asked
Does HSN 5402 20 10 require BIS certification?
No, high tenacity polyester filament yarn is outside the BIS Quality Control Order regime. Import is governed by the ITC (HS) Import Policy administered by the Directorate General of Foreign Trade, with a Pre-Shipment Inspection Certificate requirement for azo-dye absence under General Note 10.
Which accredited laboratories can issue the PSIC for azo-dye testing?
The PSIC must be issued by an accredited laboratory of the exporting country, or alternatively by a Textile Committee or CSRTI laboratory; per DGFT Public Notice 14/2023 dated 14-06-2023, no other laboratory format is accepted.
Does the azo-dye testing exemption apply if the yarn is re-labelled or re-packed in an exempt country before shipment to India?
No. The exemption under General Note 10 is tied to the country of origin of the textile article, not the country of final dispatch; re-packing or transshipment through an exempt country does not confer the exemption on goods of non-exempt origin.
