Compliance steps
  1. 1
Obtain a Pre-Shipment Inspection Certificate from an accredited laboratory of the exporting country, or a valid test report from a Textile Committee or CSRTI laboratory, certifying the absence of prohibited hazardous azo dyes. Azo-dye testing is exempted only for imports from the EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea, and the United Kingdom.

  2. 2
If the consignment originates from Bangladesh, ensure it is routed exclusively through Nhava Sheva seaport. Import of woven flax fabrics from Bangladesh via any land port on the India-Bangladesh border is prohibited; re-export of Bangladesh-origin goods to India from Nepal or Bhutan is similarly not permitted.

A word of counsel

The most frequent error on this tariff line is assuming the azo-dye testing exemption is universal. The exemption covers nine named countries only — EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea, and the United Kingdom — and a consignment from any other origin presented without a valid PSIC will be detained at port. The Bangladesh port restriction is a separate, concurrent requirement that applies regardless of dye-testing status.

Frequently asked
Does HSN 5309 19 10 require BIS certification?
No, dyed woven fabrics of flax are not covered by any BIS Quality Control Order. Import is governed by DGFT ITC (HS) import policy controls, principally the azo-dye Pre-Shipment Inspection Certificate requirement under General Note 10 and the designated-port restriction for Bangladesh-origin goods.
Does the Nhava Sheva port restriction apply to Bangladesh-origin flax fabrics transiting through Nepal or Bhutan?
Bangladesh exports transiting through India to Nepal or Bhutan are exempt from the restriction, but re-export of those goods back into India from Nepal or Bhutan is not permitted under DGFT Notification 21/2025-26.
Is a PSIC still required if the supplier holds a valid test report from a Textile Committee laboratory?
Yes, a valid test report from a Textile Committee (TC) or CSRTI laboratory is accepted as an alternative to a PSIC from an accredited laboratory in the exporting country, provided it certifies the absence of prohibited hazardous azo dyes per General Note 10.
