DGFT CLEARANCE

HSN 5210 41 40 (Suitings) is subject to ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), which mandates a Pre-Shipment Inspection Certificate (PSIC) covering hazardous azo-dye absence under General Note 10 of the ITC (HS) policy. The PSIC must be issued by an accredited laboratory of the exporting country or by the Textile Committee or CSRTI, with azo-dye testing exempted only for imports originating from nine specified countries.

Compliance steps
  1. 1
Obtain a Pre-Shipment Inspection Certificate from an accredited laboratory of the exporting country, or a valid test report from the Textile Committee (TC) or CSRTI, certifying the absence of prohibited hazardous azo dyes. This document must accompany the bill of entry for all origins not included in the exempted-country list.

  2. 2
If the consignment originates from the EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea, or the United Kingdom, azo-dye testing is exempt; however, retain documentary proof of origin and ensure all other PSIC parameters are covered. Imports from all other origins remain subject to the full azo-dye test requirement.

A word of counsel

The most common error on this tariff line is assuming that the azo-dye exemption for specified countries eliminates the PSIC requirement entirely. The exemption is limited strictly to azo-dye testing; the PSIC covering other hazardous-dye parameters remains mandatory regardless of origin. Presenting a certificate that omits non-azo hazardous-dye parameters is treated as a non-compliant document, exposing the consignment to detention and ground rent pending a conforming test report.

Frequently asked
Does HSN 5210 41 40 require BIS certification?
No, no BIS Quality Control Order covers this cotton suiting fabric. Import is governed by the ITC (HS) policy administered by the Directorate General of Foreign Trade, principally through the hazardous-dye PSIC requirement under General Note 10 of the ITC (HS) Import Policy.
Which countries are exempt from azo-dye testing under DGFT Public Notice 14/2023?
The EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea, and the United Kingdom are exempt from azo-dye testing only; all other origins must provide a PSIC or valid TC/CSRTI test report confirming absence of prohibited azo dyes.
Is a test report from the Textile Committee acceptable in lieu of a foreign accredited laboratory certificate?
Yes. A valid test report from the Textile Committee (TC) or CSRTI is explicitly accepted under General Note 10 of the ITC (HS) policy as an alternative to a PSIC from an accredited laboratory of the exporting country.
