DGFT CLEARANCE

HSN 5210 41 30 (Shirting fabrics) is subject to the ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), requiring a Pre-Shipment Inspection Certificate (PSIC) from an accredited laboratory of the exporting country, or a valid test report from a Textile Committee or CSRTI laboratory, certifying the absence of prohibited hazardous azo dyes. This obligation arises under General Note 10 of the ITC (HS) Import Policy and DGFT Public Notice 14/2023 dated 14-06-2023.

A word of counsel

The most common error on this tariff line is assuming that the country-of-origin exemption from azo-dye testing removes the PSIC requirement entirely. The exemption covers only the azo-dye component of the inspection; a test report or PSIC certifying absence of other prohibited hazardous dyes may still be required under General Note 10, and consignments arriving without any supporting inspection documentation are detained at the port of import until the document is furnished.

Frequently asked
Does HSN 5210 41 30 require BIS certification?
No, plain weave cotton-blend shirting fabrics are not within the BIS Quality Control Order regime. Import is governed by the ITC (HS) Import Policy administered by the Directorate General of Foreign Trade, principally through the hazardous-dye PSIC requirement under General Note 10 and DGFT Public Notice 14/2023.
Which countries are exempt from azo-dye testing for this tariff line?
Imports from the EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea, and the United Kingdom only are exempt from testing for the presence of azo dyes; all other origins must provide a PSIC or valid test report from a TC or CSRTI laboratory.
Can an importer substitute the PSIC with an in-house manufacturer's test certificate?
No. General Note 10 of the ITC (HS) Import Policy and DGFT Public Notice 14/2023 dated 14-06-2023 specify that the certificate must come from an accredited laboratory of the exporting country or from a Textile Committee or CSRTI laboratory; a manufacturer's own test certificate does not satisfy this requirement.
