DGFT CLEARANCE

HSN 5209 51 50 (Seersucker) is subject to the ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), which requires a Pre-Shipment Inspection Certificate (PSIC) confirming the absence of prohibited hazardous azo dyes under General Note 10 of the ITC (HS) Schedule I. The PSIC must be issued by an accredited laboratory of the exporting country, or a valid test report from a Textile Committee or CSRTI laboratory must accompany the consignment.

Compliance steps
  1. 1
Obtain a Pre-Shipment Inspection Certificate (PSIC) from an accredited laboratory of the exporting country, or a valid test report from a Textile Committee (TC) or Central Sheep and Wool Research Institute (CSRTI) laboratory, certifying the absence of prohibited hazardous azo dyes. This document must accompany the bill of entry at the port of import.

  2. 2
Verify whether the country of export qualifies for the azo-dye testing exemption. Testing for azo dyes is waived only for imports originating from the EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea, and the United Kingdom; imports from all other origins require the full PSIC with dye-test results.

A word of counsel

The most common error on this tariff line is assuming that the country-of-origin exemption from azo-dye testing eliminates the PSIC requirement altogether. The exemption applies to the azo-dye test component only; the PSIC or TC/CSRTI test report covering other prohibited hazardous dyes and composition parameters remains mandatory for all origins, including exempt countries. Presenting only a certificate of origin at the bill of entry is insufficient and will result in consignment detention pending the required test documentation.

Frequently asked
Does HSN 5209 51 50 require BIS certification?
No, woven cotton seersucker fabric is not subject to any BIS Quality Control Order. Import is governed by the ITC (HS) import policy administered by the Directorate General of Foreign Trade, specifically the hazardous-dye compliance requirement under General Note 10.
Which countries are exempt from azo-dye testing for this tariff line?
The EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea, and the United Kingdom are exempt from azo-dye testing only; a PSIC or valid TC/CSRTI test report covering other prohibited hazardous dyes remains mandatory for all origins per DGFT Public Notice 14/2023.
Can an importer use an in-house factory test report instead of an accredited laboratory PSIC?
No. General Note 10 of the ITC (HS) Schedule I requires the certificate to come from an accredited laboratory of the exporting country, or a valid test report issued by the Textile Committee or CSRTI; an internal factory report does not satisfy this requirement.
