Compliance steps
  1. 1
Obtain a Pre-Shipment Inspection Certificate from an accredited laboratory of the exporting country, or a valid test report from a Textile Committee (TC) or Central Sheep and Wool Research Institute (CSRTI) laboratory, certifying the absence of prohibited hazardous azo dyes before dispatch. This document must be available at the bill-of-entry stage.

  2. 2
Confirm the country of origin: azo-dye testing is exempted only for imports from the EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea, and the United Kingdom. For all other origins, the PSIC or valid test report is mandatory and non-negotiable at customs out-of-charge.

A word of counsel

The most common error on this tariff line is assuming the azo-dye PSIC exemption extends beyond the nine named countries. A consignment from, say, Bangladesh, Vietnam, or China arriving without a PSIC is detained at the port of import pending production of a valid test report; demurrage accrues from the date of arrival and the consignment cannot be given out-of-charge until the document is produced or the goods are re-exported.

Frequently asked
Does HSN 5209 41 90 require BIS certification?
No, plain weave cotton woven fabrics are not within the BIS Quality Control Order regime. Import is governed by the ITC (HS) policy administered by the Directorate General of Foreign Trade, specifically the hazardous azo-dye testing requirement under General Note 10.
Which countries are exempt from the azo-dye Pre-Shipment Inspection Certificate requirement?
Only the EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea, and the United Kingdom are exempt per DGFT Public Notice 14/2023 dated 14-06-2023; all other origins must furnish a PSIC or valid TC/CSRTI test report.
Can the test report be obtained after the consignment arrives in India?
No. The requirement is a Pre-Shipment Inspection Certificate or a valid test report issued before dispatch; post-arrival testing does not satisfy the General Note 10 condition and the consignment remains detained until compliant documentation is produced.
