A word of counsel

The most common error on this tariff line is assuming the azo-dye exemption extends to all developed or OECD-member origins. The exemption list is closed and enumerated: only EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea and the United Kingdom qualify. Importing from any country outside this list without a valid Pre-Shipment Inspection Certificate results in consignment detention and potential re-export at the importer's cost.

Frequently asked
Does HSN 5208 13 10 require BIS certification?
No, cotton shirting fabrics in a twill weave are not covered by any BIS Quality Control Order. Import is governed by the ITC (HS) import policy administered by the Directorate General of Foreign Trade, principally through the azo-dye Pre-Shipment Inspection Certificate requirement under General Note 10.
Which countries are exempt from the azo-dye testing requirement for this HSN?
EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea and the United Kingdom only, per DGFT Public Notice 14/2023 dated 14 June 2023; all other origins must furnish a Pre-Shipment Inspection Certificate from an accredited laboratory.
Does the azo-dye exemption for listed countries remove all Pre-Shipment Inspection Certificate obligations?
The exemption covers azo-dye testing specifically; any other PSIC or testing requirement under General Note 10 applicable to textile and textile articles remains in force even for the nine exempt origins.
