Silk waste, yarn waste and garnetted stock (other)
HSN 5003 00 90 (Other silk waste) is subject to ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), with the consignment classified as waste and subject to Para 8(B) of the General Notes regarding Import Policy and Rules 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016. A Pre-Shipment Inspection Certificate covering azo-dye absence is required for imports from most origins under General Note 10 of the ITC (HS) policy.
- Import compliance declaration from DGFT
- Pre-Shipment Inspection Certificate from exporter
- Hazardous waste compliance from MoEFCC
- 1Verify that the import complies with Para 8(B) of the General Notes regarding Import Policy of ITC (HS), which governs the import of wastes. Additionally confirm compliance with Rules 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 before filing the bill of entry.Para 8(B) of General Notes regarding Import Policy of ITC (HS) · Rules 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016
- 2For imports from countries other than the EU, Serbia, Poland, Denmark, Australia, Canada, Japan, South Korea and the United Kingdom, accompany the consignment with a Pre-Shipment Inspection Certificate from an accredited laboratory of the exporting country certifying absence of prohibited azo dyes. Imports from the listed exempt origins are relieved of the azo-dye testing requirement only.General Note 10 of the ITC (HS) Import Policy · DGFT Public Notice 14/2023 dated 14-06-2023
The most common error on this tariff line is overlooking the hazardous-waste compliance overlay: silk waste classified under 5003 00 90 is treated as waste for regulatory purposes, and importers who focus solely on the azo-dye PSIC requirement while neglecting Para 8(B) and the Hazardous Waste Rules face consignment detention and potential refusal of out-of-charge at the port of import. Confirm the waste-movement documentation under Rules 12 and 13 is in order before departure of the vessel.
