HSN 3827 90 00 (Other halogenated derivatives mixtures) is subject to import licensing administered by the Ministry of Environment, Forest and Climate Change (MEFCC) under the Montreal Protocol framework governing ozone-depleting substances. The most common error on this tariff line is the conflation of the actual-user licence with a general importer licence: only the end-user of the halogenated mixture — not a trader, agent, or intermediary — qualifies as an actual user entitled to import under this regime. A consignment cleared on the basis of a licence held by a party that then on-sells the product domestically constitutes a licence violation, attracting confiscation of goods and monetary penalty under the relevant rules, irrespective of whether the ultimate recipient was itself eligible.
