Containing 15 % or more by mass of1,1,1-trifluoroethane (HFC-143a)
HFC refrigerant blends containing HFC-143a (15% or more)
HSN 3827 61 00 (HFC-143a-containing refrigerant mixtures) is subject to the ITC (HS) Restricted-import policy administered by the Directorate General of Foreign Trade (DGFT) under policy condition no. 06 of Chapter 38, ITC (HS) 2022 Schedule I. Import is permitted only with a DGFT Import Authorisation backed by a recommendation from the Ozone Cell, Ministry of Environment, Forest and Climate Change (MoEF&CC), pursuant to DGFT Notification 59/2015-2020 dated 09-03-2022.
- Import Authorisation from DGFT
- Ozone Cell recommendation from MoEF&CC
- 1Obtain an Import Authorisation from the Directorate General of Foreign Trade before the consignment is shipped. The authorisation is conditional on a prior recommendation from the Ozone Cell, MoEF&CC, confirming the quantity and category of hydrofluorocarbons being imported.ITC (HS) 2022 Schedule I, Chapter 38, policy condition no. 06 · DGFT Notification 59/2015-2020 dated 09-03-2022
- 2Upload the DGFT Import Authorisation in e-Sanchit at the bill of entry stage and ensure the document is current and covers the specific HFC mixture being imported. Customs out-of-charge will not be granted for a Restricted-category consignment absent this authorisation.ITC (HS) 2022 Schedule I, Chapter 38, policy condition no. 06
The most common error on this tariff line is filing the bill of entry on the strength of a valid DGFT Import Authorisation without first confirming that the Ozone Cell recommendation explicitly names the HFC-143a blend and the quantity bracket. The Ozone Cell recommendation is the precondition for the authorisation itself — an authorisation issued in excess of the recommended quota is treated as void, and the excess quantity is liable to seizure and re-export under the ITC (HS) Restricted-import enforcement regime.
