Other prepared diagnostic or laboratory reagents, certified reference materials
HSN 3822 90 90 (other prepared diagnostic or laboratory reagents and certified reference materials) is subject to oversight by the Ministry of Environment, Forest and Climate Change (MEFCC) where the goods qualify as high-end, high-value used or refurbished medical equipment under the Office Memorandum dated 15 December 2023. Import of such used or refurbished equipment is Restricted and conditional on compliance with the terms of that O.M., as advised by the Directorate General of Health Services.

The critical trap on this tariff line is misclassifying new diagnostic reagents or certified reference materials alongside used or refurbished medical equipment. The MEFCC O.M. dated 15 December 2023 applies specifically to high-end, high-value used or refurbished equipment as identified by DGHS — not to new reagent kits or reference standards. Filing a bill of entry for genuinely new goods without triggering the Restricted-import conditions is correct; however, mislabelling used equipment as new to circumvent the O.M. conditions attracts detention and confiscation under Customs Act, 1962.
