HSN 3814 00 21 (composite solvents and thinners containing CFCs) is subject to Ministry of Environment, Forest and Climate Change (MoEFCC) controls under the Ozone Depleting Substances (Regulation and Control) Rules, 2000, as the product contains methane, ethane or propane chlorofluorocarbons. Import is currently Free under DGFT Notification 44/2025-26 dated 15-10-2025, but remains subject to policy conditions 1, 2, 3, 5 and 6 of Chapter 38 of the ITC (HS) schedule and to Public Liability Insurance obligations for specified hazardous substances.

- 2Where the imported quantity of specified hazardous substances exceeds the threshold prescribed under the Public Liability Insurance Act, 1991, the owner must take out a valid insurance policy before import. The most common error on this tariff line is treating the Free import status under DGFT Notification 44/2025-26 as a clearance from all regulatory obligations. The ITC (HS) policy conditions and the ODS Rules remain independently operative regardless of the tariff-policy classification; a consignment that is Free from quantity restriction can still be detained or confiscated for non-compliance with MoEFCC authorisation requirements or for breach of the Public Liability Insurance threshold obligation under S.O. 227(E).
