Organic composite solvents containing ozone-depleting halocarbons

MEFCC CLEARANCE

HSN 3814 00 13 covers organic composite solvents and thinners containing carbon tetrachloride, bromochloromethane, or 1,1,1-trichloroethane (methyl chloroform), and is regulated primarily by the Ministry of Environment, Forest and Climate Change (MEFCC) under the Ozone Depleting Substances (Regulation and Control) Rules, 2000. Compliance steps
  1. 1
Obtain MEFCC authorisation for the import of ozone-depleting substances under the Ozone Depleting Substances (Regulation and Control) Rules, 2000, as amended. Verify compliance with policy conditions 3, 5 and 6 of Chapter 38 of the ITC (HS) before filing the bill of entry; non-compliance renders the consignment liable to detention and confiscation.

  2. 2
Confirm the consignment satisfies ITC (HS) policy conditions 1 and 2 of Chapter 38 and the General Note 8(a) import-policy requirements. Note that as per DGFT Notification 44/2025-26 dated 15-10-2025 (effective Finance Bill 2025 provisions from 01-05-2025), import under this CTI is currently classified as Free, but the ODS-specific policy conditions operate independently of the Free-import status.

  3. 3
Where the imported quantity of specified hazardous substances exceeds the threshold prescribed by S.O. 227(E) dated 24-03-1992, take out a public liability insurance policy as required by the Public Liability Insurance Act, 1991. If the consignment constitutes hazardous waste, comply with Rules 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016, and General Note 8(b) of the ITC (HS) Import Policy.

A word of counsel

The most common error on this tariff line is assuming that the DGFT Free-import status under DGFT Notification 44/2025-26 dispenses with the MEFCC ODS authorisation. The Free designation governs the customs-policy classification only; the Ozone Depleting Substances (Regulation and Control) Rules, 2000 impose a parallel and independent authorisation requirement, and consignments arriving without current MEFCC clearance face seizure and confiscation irrespective of the ITC (HS) Free status.

Frequently asked
Does HSN 3814 00 13 require BIS certification?
No, no BIS Quality Control Order covers this product family. Import is governed by the Ministry of Environment, Forest and Climate Change under the Ozone Depleting Substances (Regulation and Control) Rules, 2000, with DGFT ITC (HS) policy conditions 1, 2, 3, 5 and 6 of Chapter 38 applying concurrently.
Does the DGFT Free-import classification remove the ODS authorisation requirement?
No. DGFT Notification 44/2025-26 dated 15-10-2025 classifies import as Free for customs-policy purposes, but the MEFCC authorisation under the Ozone Depleting Substances (Regulation and Control) Rules, 2000 is an independent regulatory requirement that continues to apply regardless of Free-import status.
When does the Public Liability Insurance Act, 1991 obligation trigger for this HSN?
The PLI insurance requirement triggers when the imported quantity of specified hazardous substances exceeds the threshold quantities prescribed by S.O. 227(E) dated 24-03-1992; quantities below the prescribed threshold are not subject to the mandatory insurance obligation.
