Containing methane, ethane or propane hydrochlorofluorocarbons (HCFCs), but not containing chlorofluorocarbons (CFCs)
Composite solvents containing HCFC methane, ethane or propane
HSN 3814 00 12 covers organic composite solvents and thinners containing methane-, ethane-, or propane-based hydrochlorofluorocarbons (HCFCs), and is subject to ozone-depleting-substance controls administered by the Ministry of Environment, Forest and Climate Change (MoEFCC) under the Ozone Depleting Substances (Regulation and Control) Rules, 2000. The Directorate General of Foreign Trade (DGFT) classifies import as Free under DGFT Notification 44/2025-26 dated 15-10-2025, subject to ITC (HS) policy conditions 1, 2, 3, 5 and 6 of Chapter 38. Importers of specified hazardous substances exceeding threshold quantities must additionally maintain insurance cover under the Public Liability Insurance Act, 1991.
- ODS import authorisation from MoEFCC
- ITC (HS) policy compliance from DGFT
- Insurance certificate from insurer
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade.
- 1Obtain import authorisation from the Ministry of Environment, Forest and Climate Change for HCFCs under the Ozone Depleting Substances (Regulation and Control) Rules, 2000, as amended. Confirm compliance with policy conditions 3, 5 and 6 of Chapter 38 of the ITC (HS), which govern ozone-depleting substance imports, before filing the bill of entry.Ozone Depleting Substances (Regulation and Control) Rules, 2000 · ITC (HS) policy conditions 3, 5 and 6 of Chapter 38
- 2Verify compliance with ITC (HS) policy conditions 1 and 2 of Chapter 38 and with para 8(a) of the General Notes regarding import policy. File the bill of entry reflecting the Free-import status notified by DGFT, effective 1 May 2025 per the Finance Bill 2025.DGFT Notification 44/2025-26 dated 15-10-2025 · Finance Bill 2025 effective 01-05-2025 · ITC (HS) policy conditions 1 and 2 of Chapter 38
- 3Where the import quantity of specified hazardous substances exceeds the threshold prescribed, take out a Public Liability Insurance policy before clearance. For waste consignments, ensure compliance with Rules 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 and para 8(b) of the ITC (HS) General Notes.S.O. 227(E) dated 24-03-1992 by MoEFCC · Public Liability Insurance Act, 1991 · Hazardous Waste (Management and Transboundary Movement) Rules, 2016 — Rules 12 and 13
The most common error on this tariff line is treating the DGFT Free-import status as a complete clearance and overlooking the independent MoEFCC ODS authorisation requirement, which operates on a separate track. HCFC-containing solvents are controlled under the Ozone Depleting Substances (Regulation and Control) Rules, 2000 regardless of the ITC (HS) import-policy classification; consignments arriving without a current MoEFCC authorisation are liable to detention and confiscation irrespective of the bill of entry's Free status.
