HSN 3814 00 12 covers organic composite solvents and thinners containing methane-, ethane-, or propane-based hydrochlorofluorocarbons (HCFCs), and is subject to ozone-depleting-substance controls administered by the Ministry of Environment, Forest and Climate Change (MoEFCC) under the Ozone Depleting Substances (Regulation and Control) Rules, 2000. The Directorate General of Foreign Trade (DGFT) classifies import as Free under DGFT Notification 44/2025-26 dated 15-10-2025, subject to ITC (HS) policy conditions 1, 2, 3, 5 and 6 of Chapter 38. Importers of specified hazardous substances exceeding threshold quantities must additionally maintain insurance cover under the Public Liability Insurance Act, 1991.

For waste consignments, ensure compliance with Rules 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 and para 8(b) of the ITC (HS) General Notes.

The most common error on this tariff line is treating the DGFT Free-import status as a complete clearance and overlooking the independent MoEFCC ODS authorisation requirement, which operates on a separate track.
