Other pesticides, disinfectants and similar biocidal preparations
HSN 3808 99 99 (Other) is subject to mandatory registration or import permit under Section 9 of the Insecticides Act, 1968 administered by the Central Insecticides Board and Registration Committee (CIB&RC), with import restricted to ports notified under Rule 45 of the Insecticides Rules, 1971. Central Drugs Standard Control Organisation (CDSCO) registration conditions apply where the preparation is listed as a medical device under G.S.R. 102(E) dated 11-02-2020. DGFT policy condition 7 of Chapter 29 and CBIC Circular 23/2023-Cus mandatory Chapter 38 qualifiers apply as additional clearance overlays.

- 2Confirm that none of the prohibited substances listed in S.O. 3951(E) dated 08-08-2018 — including benomyl, carbaryl, diazinon, dichlorvos, phorate, phosphamidon, triazophos, trichlorfon, alachlor, fenthion, linuron, methyl parathion, thiometon, tridemorph, fenarimol and trifluralin (except in wheat) — are present in the consignment. - 3Ensure mandatory additional qualifiers are declared in the import declaration for CTH 3808 commodities as stipulated in Para 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, with effect from 15-10-2023. The most common error on this residual tariff line is importing a preparation whose active ingredient is prohibited under S.O. 3951(E) dated 08-08-2018 on the mistaken assumption that the prohibition attaches only to the primary CTI for that substance. The prohibition is substance-specific and applies regardless of formulation or CTI; customs will confiscate a consignment containing dichlorvos, phorate, phosphamidon, triazophos or trichlorfon even where the CIB&RC registration for the formulation pre-dates the prohibition order. Verify the active-ingredient list against S.O. 3951(E) before placement of the purchase order.
