Compliance steps
  1. 1
Obtain a certificate of registration or import permit from the Central Insecticides Board and Registration Committee under Section 9 of the Insecticides Act, 1968 before shipment. No insecticide may be imported from a source other than that specified on the certificate of registration or permit; ensure the supplier name matches the registered source exactly.

  2. 2
Route the consignment only through ports notified under Rule 45 of the Insecticides Rules, 1971. At the bill of entry, ensure compliance with the mandatory additional qualifiers for CTH 3808 under CBIC Circular 23/2023-Cus dated 30-09-2023, para 4.1 and 4.2, operative from 15-10-2023.

  3. 3
Verify the specific active ingredient is not among the prohibited substances under S.O. 3951(E) dated 08-08-2018, which prohibits import of benomyl, carbaryl, diazinon, fenarimol, fenthion, linuron, methoxy ethyl mercury chloride, methyl parathion, thiometon, tridemorph, and — effective 1 January 2019 — trifluralin, alachlor, dichlorvos, phorate, phosphamidon, triazophos, and trichlorfon. Where the product qualifies as a medical device under G.S.R. 102(E) dated 11-02-2020, CDSCO registration is an additional mandatory condition.

A word of counsel

The most common error on this tariff line is importing against a valid CIB&RC registration but from a supplier not named on that registration certificate. The Insecticides Act, 1968 treats source-of-import as a binding condition of registration, not a procedural formality — a consignment shipped from an unregistered source is liable to seizure at the notified port even when the active ingredient and formulation are identical to the registered product. Verify the exporting manufacturer's name against the registration certificate before placing every purchase order.

Frequently asked
Does HSN 3808 99 92 require BIS certification?
No, this tariff line falls outside the BIS Quality Control Order regime. Import is governed by the Central Insecticides Board and Registration Committee under the Insecticides Act, 1968, with a concurrent CDSCO registration requirement where the product is a listed medical device under G.S.R. 102(E) dated 11-02-2020.
Which active ingredients are prohibited from import under this tariff line?
S.O. 3951(E) dated 08-08-2018 prohibits import of benomyl, carbaryl, diazinon, fenarimol, fenthion, linuron, methoxy ethyl mercury chloride, methyl parathion, thiometon, and tridemorph outright, and bans alachlor, dichlorvos, phorate, phosphamidon, triazophos, and trichlorfon with effect from 1 January 2019; sodium cyanide is banned for insecticidal use.
Does the policy condition 7 of Chapter 29 apply even though this is a Chapter 38 tariff line?
Yes. DGFT Notification 44/2025-26 dated 15-10-2025 explicitly subjects this CTI to policy condition 7 of Chapter 29; importers must ensure compliance with that condition alongside the CIB&RC registration and the mandatory CBIC Chapter 29/3808 qualifiers under CBIC Circular 23/2023-Cus.
