Containing bromomethane (methyl bromide) or bromochloromethane
Methyl bromide and bromochloromethane fumigant preparations
HSN 3808 99 91 (containing bromomethane/methyl bromide or bromochloromethane) is subject to mandatory registration under Section 9 of the Insecticides Act, 1968, administered by the Central Insecticides Board and Registration Committee (CIB&RC), and to ozone-depleting-substance controls under the Ozone Depleting Substances (Regulation and Control) Rules, 2000 administered by the Ministry of Environment, Forest and Climate Change (MEFCC). Import of methyl bromide is Restricted to actual users holding a licence and sourced exclusively from countries party to the Montreal Protocol; consignments from non-party countries are prohibited. Central Drugs Standard Control Organisation (CDSCO) registration requirements apply where the preparation falls within the medical-device list notified under G.S.R. 102(E) dated 11-02-2020.
- Registration certificate or import permit from CIB&RC
- Montreal Protocol country licence from MEFCC
- Chapter 29/38 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a Certificate of Registration or an import permit from the Central Insecticides Board and Registration Committee under Section 9 of the Insecticides Act, 1968 before shipment. The certificate specifies the approved source of import; no consignment may be imported from a source other than that named on the registration or permit.Section 9 of the Insecticides Act, 1968; Rule 45 of the Insecticides Rules, 1971
- 2Confirm the exporting country is a party to the Montreal Protocol; import from non-party countries is prohibited. For each consignment, submit a copy of the bill of entry within 30 days to the Ozone Cell, Ministry of Environment, Forest and Climate Change, New Delhi, as required by the Ozone Depleting Substances (Regulation and Control) Rules, 2000.Ozone Depleting Substances (Regulation and Control) Rules, 2000; ITC (HS) policy conditions for methyl bromide (CTI 38089122); Appendix IV to the ITC (HS) Schedule
- 3Ensure mandatory additional qualifiers for Chapter 38 and CTH 3808 commodities are included in the import declaration, with full compliance to CBIC Circular 23/2023-Cus dated 30-09-2023, paragraphs 4.1 and 4.2, effective 15-10-2023. Additionally, verify that the importing entity holds public-liability insurance under the PLI Act, 1991 (S.O. 227(E) dated 24-03-1992) if the hazardous substance is imported in quantities exceeding the specified threshold.CBIC Circular 23/2023-Cus dated 30-09-2023; S.O. 227(E) dated 24-03-1992; DGFT Notification 44/2025-26 dated 15-10-2025
The most consequential trap on this tariff line is the dual-track obligation: importers who secure CIB&RC registration but fail to comply with the Montreal Protocol country-of-origin restriction face an outright prohibition — the registration does not cure a non-party-country sourcing breach, and the consignment is liable to seizure and confiscation. Additionally, the 30-day bill-of-entry submission to the MEFCC Ozone Cell is a post-clearance compliance obligation that is routinely missed; failure to submit attracts regulatory action under the Ozone Depleting Substances Rules independently of customs clearance.
