HSN 3808 94 90 (Disinfectants, Other) is subject to Central Drugs Standard Control Organisation (CDSCO) registration requirements under G.S.R. 102(E) dated 11-02-2020 where the product qualifies as a listed medical device, and to Central Insecticides Board and Registration Committee (CIB&RC) mandatory registration under Section 9 of the Insecticides Act, 1968 where the product is used as an insecticide. The Directorate General of Foreign Trade (DGFT) classifies this tariff line as Free subject to policy condition 7 of Chapter 29, and CBIC Circular 23/2023-Cus mandates additional Chapter 38 qualifiers in the import declaration effective 15 October 2023.

The most common error on this tariff line is treating the CIB&RC registration as universally applicable and overlooking the parallel CDSCO track for disinfectants listed as medical devices under G.S.R. 102(E). A product that falls within the notified medical-device list requires CDSCO registration and compliance with the Medical Devices Rules, 2017 in addition to — not instead of — any applicable Insecticides Act obligations; presenting only a CIB&RC registration for a notified medical-device disinfectant will result in detention and demand for CDSCO documentation at the port of import.
