HSN 3808 94 20 covers disinfectants specified in Supplementary Note 14 to Chapter 38 and is subject to dual primary-regulator control: the Central Insecticides Board and Registration Committee (CIB&RC) requires mandatory registration under Section 9 of the Insecticides Act, 1968, while the Central Drugs Standard Control Organisation (CDSCO) requires registration for any product also listed as a medical device under G.S.R. 102(E) dated 11-02-2020. Import is Free under the ITC (HS) policy per DGFT Notification 44/2025-26, subject to policy condition 7 of Chapter 29 and CBIC mandatory-qualifier obligations under Circular 23/2023-Cus.

The most common error on this tariff line is treating the CIB&RC registration as the only compliance gate and overlooking the CDSCO medical-device registration that applies when the disinfectant product is also listed in G.S.R. 102(E) dated 11-02-2020. Both registrations are independently required where the product is dual-scope, and customs out-of-charge will be withheld if either is absent in e-Sanchit. Additionally, the port-of-import restriction under Rule 45 of the Insecticides Rules, 1971 is absolute — diversion to an unlisted port triggers detention and seizure independent of registration status.
