Herbicides, anti-sprouting products and plant-growth regulators (Supplementary Note 10)
HSN 3808 93 72 (herbicides, anti-sprouting products and plant-growth regulators specified in Supplementary Note 10 to Chapter 38) is subject to import permit and registration requirements administered by the Central Insecticides Board and Registration Committee (CIB&RC) under the Insecticides Rules, 1971, pursuant to policy condition 04 of Chapter 38. Import is restricted to specified ports under Rule 45 of the Insecticides Rules, 1971, with additional NDPS, CBIC mandatory-qualifier, and ITC (HS) policy overlays applying as concurrent clearance requirements.

- 2Route the consignment only through a port notified under Rule 45 of the Insecticides Rules, 1971, at which insecticides may lawfully be imported. Diversion to a non-notified port constitutes a separate contravention of the Insecticides Rules, 1971 independently of any CIB&RC permit status. - 3Where the consignment contains a substance listed under the Narcotic Drugs and Psychotropic Substances regime, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 for medical and scientific purpose imports under Chapter VII-A, or confirm ITC (HS) policy condition 2 of Chapter 29 governs the import. The most common error on this tariff line is treating CIB&RC registration as identical to the CIB&RC import permit: they are distinct instruments, and shipment can be detained even where the product is registered if the specific import permit for the consignment quantity and source has not been obtained beforehand. Additionally, the mandatory additional qualifiers under CBIC Circular 23/2023-Cus for CTH 3808 declarations — operative from 15 October 2023 — are a hard filing requirement; bills of entry filed without the prescribed qualifiers in para 4.1 and 4.2 are liable to rejection at the system level.
