Herbicides, anti-sprouting products and plant-growth regulators (Supplementary Note 13)
HSN 3808 93 42 covers goods specified in Supplementary Note 13 to Chapter 38 and is subject to mandatory registration or import-permit requirements administered by the Central Insecticides Board and Registration Committee (CIB&RC) under Section 9 of the Insecticides Act, 1968, with import restricted to notified places under Rule 45 of the Insecticides Rules, 1971. Where the goods are additionally classified as medical devices under G.S.R. 102(E) dated 11-02-2020, Central Drugs Standard Control Organisation (CDSCO) registration applies as a concurrent overlay. The most common error on this tariff line is importing from a source not specified on the CIB&RC registration certificate or permit. The Registration Committee's approval is source-specific — a change of supplier or country of origin after the certificate is granted requires a fresh or amended registration, and consignments from an unapproved source attract seizure under the Insecticides Act, 1968 regardless of the validity of the registration for other sources.
