HSN 3808 92 91 (fungicides containing bromomethane or bromochloromethane) is subject to mandatory registration under Section 9 of the Insecticides Act, 1968 administered by the Central Insecticides Board and Registration Committee (CIB&RC), and import of methyl bromide (bromomethane) is additionally regulated as an ozone-depleting substance under the Ozone Depleting Substances (Regulation and Control) Rules, 2000 administered by the Ministry of Environment, Forest and Climate Change (MEFCC). Where any product in this tariff line is listed as a medical device under G.S.R. 102(E) dated 11-02-2020, Central Drugs Standard Control Organisation (CDSCO) registration conditions also apply; import is free under DGFT Notification 44/2025-26 dated 15-10-2025, subject to policy condition 7 of Chapter 29.

The most common error on this tariff line is assuming that CIB&RC registration alone covers the full compliance requirement for methyl bromide. The Montreal Protocol overlay is independent: import must originate from a Protocol-party country listed in Appendix IV of the ITC (HS) Schedule, and the 30-day post-clearance bill-of-entry submission to the Ozone Cell, MEFCC is a separate and binding obligation — failure to submit triggers a distinct contravention under the Ozone Depleting Substances (Regulation and Control) Rules, 2000, irrespective of whether the CIB&RC registration is current.
