    File mandatory additional qualifiers in the import declaration for Chapter 38 commodities, as stipulated in Para 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, with effect from 15-10-2023. For each methyl bromide consignment, submit a copy of the bill of entry within 30 days to the Ozone Cell, Ministry of Environment, Forest and Climate Change, New Delhi.

    Verify that the specific chemical in the consignment is not among the prohibited insecticides under S.O. 3951(E) dated 08-08-2018 issued by the Ministry of Agriculture and Farmers Welfare. Import quantities of specified hazardous substances exceeding prescribed thresholds also require an insurance policy under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992 issued by MOEF.

The most common error on this tariff line is assuming that CIB&RC registration alone covers the full compliance requirement for methyl bromide. The Montreal Protocol overlay is independent: import must originate from a Protocol-party country listed in Appendix IV of the ITC (HS) Schedule, and the 30-day post-clearance bill-of-entry submission to the Ozone Cell, MEFCC is a separate and binding obligation — failure to submit triggers a distinct contravention under the Ozone Depleting Substances (Regulation and Control) Rules, 2000, irrespective of whether the CIB&RC registration is current.
