HSN 3808 92 80 covers fungicides specified in Supplementary Note 11 to Chapter 38 and is subject to mandatory registration or import permit under Section 9 of the Insecticides Act, 1968, administered by the Central Insecticides Board and Registration Committee (CIB&RC). Goods that also qualify as medical devices under G.S.R. 102(E) dated 11-02-2020 require Central Drugs Standard Control Organisation (CDSCO) registration, and all declarations must carry Chapter 29 mandatory qualifiers per CBIC Circular 23/2023-Cus. Import is Free under DGFT Notification 44/2025-26 subject to policy condition 7 of Chapter 29 and port restrictions under Rule 45 of the Insecticides Rules, 1971.

The most common error on this tariff line is importing from a supplier not named on the CIB&RC certificate of registration or permit. The Registration Committee's source-of-import condition is a licence term, not a mere administrative preference — a mismatch between the declared supplier and the registered source renders the entire consignment liable to seizure under the Insecticides Act, 1968, irrespective of whether the product formulation itself is compliant. Verify the source field on the registration document against the bill of lading before the purchase order is placed.
