HSN 3808 92 70 covers fungicides listed under Supplementary Note 6 to Chapter 38 and is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968, per policy condition 04 of Chapter 38. Import is restricted to notified ports under Rule 45 of the Insecticides Rules, 1971, and CBIC mandatory Chapter 38 qualifiers in the import declaration apply from 15 October 2023.

The most frequent compliance failure on this tariff line is presenting a CIB&RC registration certificate without a separate import permit — these are two distinct instruments, and customs out-of-charge will be refused if either is absent. Where the fungicide formulation also contains a scheduled NDPS substance, the NDPS import certificate under Rule 53 is a further concurrent requirement and is not subsumed by the CIB&RC permit. Importers should also verify insurance coverage obligations under the Public Liability Insurance Act, 1991 for specified hazardous substances exceeding the quantities notified by S.O. 227(E) dated 24-03-1992.
