Other insecticides in retail or prepared forms
HSN 3808 91 99 (Other insecticides) is subject to Central Drugs Standard Control Organisation (CDSCO) registration under G.S.R. 102(E) dated 11-02-2020 issued by the Ministry of Health and Family Welfare (MOHFW) for any insecticide product listed as a medical device therein. Import is additionally governed by ITC (HS) policy conditions 1, 2, 4 and 7 of Chapter 38 administered by the Directorate General of Foreign Trade (DGFT), and import locations are restricted to ports specified under Rule 45 of the Insecticides Rules, 1971.

The most common error on this residual tariff line is assuming that CDSCO registration applies only if the product is explicitly labelled as a medical device — but the operative trigger is G.S.R. 102(E)'s enumerated list, not the product's commercial label. An insecticide that falls within that notified list requires CDSCO registration regardless of how the exporter has categorised it, and a consignment arriving without that registration cannot be regularised at port; it faces refusal of out-of-charge and prospective re-export or confiscation.
