Malathion insecticide, organophosphate pesticide formulations
HSN 3808 91 24 (Malathion) is subject to Central Drugs Standard Control Organisation (CDSCO) registration requirements under G.S.R. 102(E) dated 11-02-2020, issued by the Ministry of Health and Family Welfare (MOHFW), where the product is classified as a listed medical device. Import is also governed by ITC (HS) policy conditions 1, 2, 4 and 7 of Chapter 38 administered by the Directorate General of Foreign Trade (DGFT), with import ports restricted under Rule 45 of the Insecticides Rules, 1971.

- 3Include all mandatory additional qualifiers in the import declaration for CTH 3808 as stipulated in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, applicable with effect from 15-10-2023. The most common error on this tariff line is importing a Malathion-based formulation without first determining whether it falls within the G.S.R. 102(E) medical-device list — a product that is also used in public-health vector-control applications may simultaneously attract CDSCO registration and insecticide-import-port restrictions under Rule 45 of the Insecticides Rules, 1971. Presenting only one clearance when both are triggered causes consignment detention; the CBIC Circular 23/2023-Cus Chapter 38 qualifier requirement applies independently of both PGA tracks and must not be overlooked.
