HSN 3808 91 23 (Dimethoate, technical grade) is subject to the Central Drugs Standard Control Organisation (CDSCO) registration conditions under G.S.R. 102(E) dated 11-02-2020 issued by the Ministry of Health and Family Welfare (MOHFW). The tariff line is Free under DGFT Notification 45/2025-26 dated 15-10-2025, subject to ITC (HS) policy conditions 1, 2, 4, and 7 of Chapter 38, and import is restricted to designated ports under Rule 45 of the Insecticides Rules, 1971.

The most common error on this tariff line is overlooking the mandatory additional qualifiers required under CBIC Circular 23/2023-Cus paragraphs 4.1 and 4.2 for CTH 3808 declarations. An import declaration filed without these qualifiers after 15 October 2023 is treated as a deficient entry and attracts detention and reassessment, regardless of whether the CDSCO registration and port conditions are otherwise satisfied. Separately, importers sourcing from a new foreign supplier must confirm CDSCO registration coverage before shipment to avoid consignment seizure at the designated port.
