Methyl bromide insecticide, fumigant preparation
HSN 3808 91 22 (Methyl bromide) is subject to Central Drugs Standard Control Organisation (CDSCO) registration conditions and Ministry of Health and Family Welfare (MOHFW) notification G.S.R. 102(E) dated 11-02-2020 for any medical-device-classified formulations, alongside ITC (HS) Restricted-import policy administered by the Directorate General of Foreign Trade (DGFT) under policy conditions 1, 2, 4 and 7 of Chapter 38, as amended by DGFT Notification 45/2025-26 dated 15-10-2025. Import is permitted only through ports specified under Rule 45 of the Insecticides Rules, 1971, with mandatory Chapter 38 additional qualifiers in import declarations per Central Board of Indirect Taxes and Customs (CBIC) Circular 23/2023-Cus.

The most common error on this tariff line is failing to distinguish between methyl bromide as a bulk insecticide/fumigant and any formulated preparation that may be classified as a medical device under G.S.R. 102(E) — the CDSCO registration obligation attaches to the latter category and is not negated by holding a DGFT import authorisation. A consignment cleared under the DGFT authorisation alone, without CDSCO registration where the medical-device classification applies, is liable to seizure and confiscation under the Drugs and Cosmetics Act, 1940, independently of the Insecticides Act, 1968 compliance.
