- 2Route the consignment only through ports notified under Rule 45 of the Insecticides Rules, 1971. For formulation imports, ensure compliance with CBIC Circular 07/2014-Cus dated 07-03-2014, and confirm ITC (HS) policy conditions 1, 2, 4, and 7 of Chapter 38 are satisfied, including the free-import status confirmed by DGFT Notification 45/2025-26 dated 15-10-2025.Rule 45 of the Insecticides Rules, 1971 · CBIC Circular 07/2014-Cus dated 07-03-2014 · DGFT Notification 45/2025-26 dated 15-10-2025
- 3Include all mandatory additional qualifiers in the import declaration for CTH 3808 goods as required under paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, effective 15-10-2023. Declarations filed without the prescribed qualifiers are subject to customs rejection at the bill-of-entry stage.CBIC Circular 23/2023-Cus dated 30-09-2023, para 4.1 and 4.2
The most common error on this tariff line is treating the free-import status confirmed by DGFT Notification 45/2025-26 as dispensing with the CDSCO and port-restriction obligations. The ITC (HS) policy conditions 1, 2, 4, and 7 survive independently of free-import status, and if the formulation falls within G.S.R. 102(E), the CDSCO registration requirement is triggered regardless of the trade-policy classification. Consignments arriving at non-notified ports under Rule 45 of the Insecticides Rules, 1971 face detention and potential confiscation even where all other documentation is in order.
