Calcium cyanide insecticide, formulations and preparations
HSN 3808 91 12 (Calcium cyanide) is subject to Central Drugs Standard Control Organisation (CDSCO) registration conditions under G.S.R. 102(E) dated 11-02-2020 issued by the Ministry of Health and Family Welfare (MOHFW), alongside ITC (HS) policy conditions 1, 2, 4 and 7 of Chapter 38 administered by the Directorate General of Foreign Trade (DGFT). Import is permitted only at ports specified under Rule 45 of the Insecticides Rules, 1971, and CBIC Circular 23/2023-Cus mandates additional declaration qualifiers for Chapter 38 commodities.

- 3Include mandatory additional qualifiers in the import declaration for Chapter 38 / CTH 3808 commodities as stipulated in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus, applicable with effect from 15-10-2023. The most common error on this tariff line is treating calcium cyanide as a straightforward insecticide import and overlooking the CDSCO registration overlay triggered by G.S.R. 102(E) dated 11-02-2020. Where the product or its formulation falls within the schedule to that notification, CDSCO registration is a condition precedent — not a concurrent step — and the port-of-import restriction under Rule 45 of the Insecticides Rules, 1971 operates independently; a CDSCO-registered consignment arriving at an undesignated port is nonetheless detained.
