Insecticides and fungicides in medium retail packings
HSN 3808 62 00 (insecticides, fungicides, herbicides and similar products in packings exceeding 300 g but not exceeding 7.5 kg) is subject to ITC (HS) import policy conditions 1, 2 and 4 of Chapter 38 administered by the Directorate General of Foreign Trade (DGFT). Import is restricted to ports designated under Rule 45 of the Insecticides Rules, 1971, and the Central Board of Indirect Taxes and Customs (CBIC) mandates additional Chapter 38 qualifiers in the import declaration with effect from 15 October 2023.

The most common error on this tariff line is filing the import declaration without the mandatory additional qualifiers for CTH 3808 required under CBIC Circular 23/2023-Cus: a declaration that is technically complete in all other respects will still attract detention and demurrage if the Chapter 38 qualifiers are absent or incorrectly populated. Separately, the port-of-import restriction under Rule 45 of the Insecticides Rules, 1971 is independent of the DGFT policy conditions — routing a consignment through a non-designated port voids the lawful basis of the import even when the policy conditions are satisfied.
