Other insecticides, fungicides, herbicides and disinfectants (retail packaged)
HSN 3808 59 00 (Other insecticides, fungicides, herbicides, anti-sprouting products, plant-growth regulators and disinfectants in retail packings) is subject to ITC (HS) import policy conditions 1, 2 and 4 to Chapter 38 administered by the Directorate General of Foreign Trade (DGFT). Import of insecticides is additionally restricted to specified ports under Rule 45 of the Insecticides Rules, 1971, and Central Board of Indirect Taxes and Customs (CBIC) mandatory declaration qualifiers apply under CBIC Circular 23/2023-Cus.

The most common error on this tariff line is filing the bill of entry without the mandatory additional qualifiers required under CBIC Circular 23/2023-Cus for CTH 3808, resulting in the declaration being rejected or the consignment detained pending amendment. The qualifiers obligation is independent of the port-restriction and ITC (HS) policy-condition checks; all three layers must be satisfied concurrently, and a consignment cleared on policy grounds alone but deficient in qualifiers remains subject to CBIC scrutiny.
