HSN 3307 10 90 (Other pre-shave, shaving or after-shave preparations) is subject to import controls administered by the Ministry of Environment, Forest and Climate Change (MEFCC) under Rule 10 of the Ozone Depleting Substances (ODS) Rules, 2000, where the product is an aerosol formulation. Aerosol preparations under this tariff line require a licence from the Directorate General of Foreign Trade (DGFT) unless the product is demonstrably ODS-free, in which case a label declaration confirming the absence of ozone-depleting substances must accompany the consignment before import.

The most common error on this tariff line is assuming the ODS licence requirement applies only to conventional CFC-based aerosols — in fact, the Schedule VII trigger under Rule 10 of the ODS Rules, 2000 covers the aerosol product category broadly, and the burden falls on the importer to demonstrate ODS-free status through a label declaration before the bill of entry is filed. A consignment arriving without either the DGFT licence or the ODS-free label declaration will be detained at the port of entry, with demurrage accruing until the deficiency is rectified or the consignment is re-exported.
