Other medicaments for therapeutic or prophylactic use
HSN 3004 90 69 (Other medicaments) is subject to Narcotic Drugs and Psychotropic Substances (NDPS) import controls under S.O. 1761(E) dated 26-04-2018 for psychotropic substances such as tramadol, and to Ministry of Environment, Forest and Climate Change (MEFCC) conditions for high-value used or refurbished medical equipment. The Directorate General of Foreign Trade (DGFT) Restricted-import policy under Notification 09/2015-2020 governs the import of oxytocin, which is prohibited except for reference standards for test and analysis.
- Import certificate from Narcotics Commissioner
- Certificate of Analysis from CDSCO
- Batch release certificate from manufacturer
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade.
- 1For any consignment containing tramadol or other psychotropic substances listed under Rule 53 of the NDPS Rules, obtain an import certificate from the Narcotics Commissioner before shipment. No out-of-charge is permitted without this certificate; its absence constitutes a prohibited-import violation.Rule 53 of the NDPS Rules · S.O. 1761(E) dated 26-04-2018, Department of Revenue
- 2Upload all three mandatory documents in e-Sanchit before filing the bill of entry: Certificate of Analysis — Drug (document code 0010dc), Batch Release Certificate (document code 0030dc), and Label of Consignment (document code 0110dc). The proper officer will verify these documents before granting out-of-charge.CBIC e-Sanchit document codes 0010dc, 0030dc, 0110dc
- 3Import of oxytocin is prohibited; import of oxytocin reference standards is permitted exclusively for test and analysis upon submission of a test licence issued by DGCI/CDSCO. High-value used or refurbished medical equipment (non-critical-care) is Restricted and subject to MEFCC conditions per the O.M. dated 15-12-2023.S.O. 2357(E) dated 23-05-2022 · DGFT Notification 09/2015-2020 dated 23-05-2022 · MEFCC O.M. dated 15-12-2023
The most frequent compliance failure on this residual medicaments line is failing to distinguish between the prohibition on oxytocin as a finished product and the narrow carve-out permitting oxytocin reference standards solely for test and analysis — importers who ship finished oxytocin-containing formulations without verifying the prohibition face confiscation and prosecution under the DGFT policy condition. Separately, consignments containing tramadol are sometimes presented without the Narcotics Commissioner's import certificate on the assumption that the CDSCO batch release documents suffice; they do not, and the consignment will be detained pending NDPS clearance.
