CPCB CLEARANCE

HSN 2713 11 90 (not calcined petroleum coke, other) is subject to Central Pollution Control Board (CPCB) monitoring and a multi-track ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT) under revised Policy Condition 6 of Chapter 27. Import of pet coke for fuel purposes is prohibited; permitted uses are tightly ring-fenced to specific industries on an actual-user basis, with a separate Restricted track requiring DGFT import authorisation for low-sulphur pet coke used in integrated steel plants.

Compliance steps
  1. 1
Determine which permitted-use track applies before filing the bill of entry. Import is Free for cement, lime kiln, calcium carbide, gasification, and graphite electrode industries (feedstock/manufacturing process, actual-user basis); needle pet coke (NPC) with sulphur below 0.8% is Free as feedstock for graphite anode material for Li-ion batteries; all other imports for fuel or trade purposes are prohibited under Policy Condition 6 of Chapter 27.

  2. 2
If importing low-sulphur pet coke for use in an integrated steel plant (blending with coking coal in recovery-type coke ovens with desulphurisation plant, limited to 10% of feedstock with sulphur content not exceeding 3%), obtain an Import Authorisation from DGFT before shipment. Comply with MoEF&CC guidelines issued vide O.M. No. Q-18011/54/2018-CPA dated 10-09-2018 and ensure continuous SO₂ analysers are installed and monitored by the relevant State Pollution Control Board or CPCB.

  3. 3
For aluminium-industry imports of raw petroleum coke (RPC) or calcined petroleum coke (CPC), observe the annual quantity caps (1.9 million MT of RPC and 0.8 million MT of CPC from 2025-26 onwards), import only as feedstock/raw material on an actual-user basis, and comply in full with Commission for Air Quality Management (CAQM) Order No. F.No. 160014/16/2021-MERD/PETCOKE-35 dated 14-02-2024. RPC imported by calciners must not be transferred to any other unit, and export of CPC by calciners or export of anode by aluminium industry is not permitted.

A word of counsel

The single most consequential error on this tariff line is conflating the multiple Free-track carve-outs with a general permission to import pet coke freely. Each permitted-use category is a closed, industry-specific, actual-user track: importing under one track's declared end-use and diverting to fuel, trade, or a non-listed process is treated as a prohibited import, triggering confiscation and monetary penalty under the Customs Act, 1962. Sulphur content thresholds — 0.8% for NPC and 3% for low-sulphur pet coke in ISPs — are not self-declared; they are monitored by SPCBs and CPCB, and a non-conforming consignment cannot be remediated post-clearance.

Frequently asked
Does HSN 2713 11 90 require BIS certification?
No, not-calcined petroleum coke is not covered by any BIS Quality Control Order. Import is governed by ITC (HS) Policy Condition 6 of Chapter 27 administered by the Directorate General of Foreign Trade, with CPCB and State Pollution Control Boards mandated to monitor sulphur content and end-use compliance.
Is a DGFT Import Authorisation required for all imports under this tariff line?
No. Import is Free — without authorisation — for cement, lime kiln, calcium carbide, gasification, and graphite electrode industries (as feedstock) and for NPC with sulphur below 0.8% destined for Li-ion battery anode manufacturing. A DGFT Import Authorisation is required only for the Restricted low-sulphur pet coke track, limited to integrated steel plants per DGFT Notification 10/2023 dated 02-06-2023.
What happens if pet coke imported under a Free-track carve-out is subsequently used as fuel?
Use as fuel falls within the prohibited category under Policy Condition 6 of Chapter 27; diversion from the declared actual-user end-use renders the import unauthorised, exposing the importer to confiscation of the goods and monetary penalty under the Customs Act, 1962, independent of any CPCB or SPCB action.
