Solvent 125/240 (petroleum hydrocarbon solvent) as specified under standard IS 1745
Petroleum hydrocarbon solvent (Solvent 125/240, IS 1745)
HSN 2710 19 20 (Solvent 125/240) is subject to Petroleum and Explosives Safety Organisation (PESO) licensing for import, transport, and storage under the Petroleum Rules, 2002, as a Class B petroleum product. The tariff line is subject to policy condition (5) of Chapter 27 administered by the Directorate General of Foreign Trade (DGFT) under DGFT Notification 27/2015-20 dated 16-09-2021. Import is additionally restricted to ports and places approved by the Ministry of Shipping and declared as customs ports.
- Import licence from PESO
- Approved-port declaration to CBIC
- ITC (HS) policy condition compliance from DGFT
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade.
- 1Obtain a licence from the Chief Controller of Explosives, Petroleum and Explosive Safety Organisation (PESO), Nagpur, covering import, transport, and storage of this Class B petroleum product before the bill of entry is filed. Operating without a current PESO licence renders the consignment liable to seizure and prosecution under the Petroleum Rules, 2002.Petroleum Rules, 2002 · DGFT Notification 27/2015-20 dated 16-09-2021 (policy condition 5 of Chapter 27)
- 2Route the consignment exclusively through a port or place approved by the Ministry of Shipping in consultation with the Chief Controller and declared as a customs port. Arrival at an unapproved port is a violation of the Petroleum Rules, 2002 and attracts detention and re-export or confiscation.Petroleum Rules, 2002 (approved-port requirement)
- 3Ensure all containers used for storing the imported Class B petroleum product conform to the specifications in Rules 4, 5, and 6 of the Petroleum Rules, 2002. Be alert to misdeclaration risk: DRI Alert Circular 02/2020-CI dated 23-04-2020 flags hydrocarbon solvents as a category prone to misdeclaration as low-aromatic white spirit or IMPS.Rules 4, 5 and 6 of the Petroleum Rules, 2002 · DRI Alert Circular 02/2020-CI dated 23-04-2020
The most common error on this tariff line is treating the DGFT policy-condition compliance as the sole clearance requirement and overlooking the independent PESO licence, which covers import, transport, and storage as three separately licensed activities. A consignment that arrives with DGFT policy-condition documentation but without a current PESO licence is detained at the approved port and cannot obtain out-of-charge; storage at any unlicensed premises during or after transit constitutes a separate Petroleum Rules contravention.
