Other non-alcoholic beverages, not elsewhere specified
HSN 2202 99 90 (other non-alcoholic beverages not elsewhere classified) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006, and the FSS (Import) Regulations, 2017. Consignments must enter through designated food-import ports per General Note 4(D) of Schedule I of the ITC (HS) 2022, administered by the Directorate General of Foreign Trade (DGFT), with Central Board of Indirect Taxes and Customs (CBIC) customs-instruction overlays governing document verification at the bill of entry.
- Import Licence from FSSAI
- Specimen copy of label from FSSAI
- Food-import port declaration to CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a current FSSAI Import Licence before shipment and upload it in e-Sanchit under document code 911001. Also upload a specimen copy of the product label under document code 0110FS; both documents must be present before the customs proper officer grants out-of-charge.CBIC Instruction 10/2022-Cus dated 28-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023 · FSSAI order dated 18-11-2022 under F.No.Import/TFM/Apex/2022-FSSAI
- 2Route the consignment exclusively through a designated food-import entry point in compliance with General Note 4(D) of Schedule I of the ITC (HS) 2022. Any labelling deficiencies permissible for rectification under the FSS (Labelling and Display) Regulations, 2020 must be corrected at a customs bonded warehouse by affixing a single non-detachable sticker adjacent to the principal display panel before visual inspection by the authorised officer.General Note 4(D), ITC (HS) Schedule I, 2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · CBIC Instruction 10/2022-Cus dated 28-06-2022
- 3If the origin country is Bangladesh or the consignment involves goods subject to DGFT Notification 7/2025-26 dated 17-05-2025, verify applicability of Para 19 of the General Notes regarding port restrictions and exemptions under Para 2 and Para 3 of that notification before filing the bill of entry.DGFT Notification 7/2025-26 dated 17-05-2025
The single most common error on this tariff line is treating label rectification as a post-arrival entitlement rather than a conditional dispensation. Rectification is available only for the specific deficiencies enumerated in the FSS (Labelling and Display) Regulations, 2020 and the FSSAI orders of 22-05-2018 and 14-01-2019; a missing FSSAI Import Licence or a China-origin product falling within the melamine-risk prohibition under DGFT Notification 01/2015-20 dated 23-04-2019 cannot be remedied at the port and will result in consignment detention or re-export.
