Compliance steps
  1. 1
Obtain the FSSAI Import Licence (document code 911001) and confirm — where the food preparation falls within the high-risk categories (nutraceuticals, infant food, milk products, meat products, fish products, egg powder, health supplements, probiotics, foods for special medical purpose) — that the foreign manufacturing facility is registered with FSSAI. Upload the FSSAI Import Licence and the Specimen Copy of Label (document code 0110FS) in e-Sanchit before filing the bill of entry.
    CBIC Instruction 30/2022-Cus dated 14-11-2022 · FSSAI order dated 10-10-2022 · CBIC Instruction 05/2023-Cus dated 08-02-2023
  2. 2
Where the food preparation contains animal-origin ingredients listed in Annexure A of CBIC Circular 24/2022-Cus, upload the Veterinary Health Certificate (document code 853AQ1) and the Laboratory Report or Certificate of Analysis (document code 001AQ1) issued by the exporting country in e-Sanchit. The Health Certificate (document code 6360AQ) is also mandatory for AQCS-covered preparations.

  3. 3
Route the consignment exclusively through one of the 79 designated food-import ports under General Note 4(D) of Schedule I of the ITC (HS) 2022. Note that import of milk-based food preparations, chocolates, confectioneries, and food preparations with milk or milk solids from China is prohibited under DGFT Notification 01/2015-20 dated 23-04-2019 until port laboratories are upgraded for melamine testing.
    CBIC Instruction 05/2023-Cus dated 08-02-2023 · General Note 4(D) of ITC (HS) 2022 · DGFT Notification 01/2015-20 dated 23-04-2019
A word of counsel

The residual nature of HSN 2106 90 99 means a single consignment can simultaneously trigger FSSAI foreign-manufacturer registration, AQCS veterinary clearance, and the China-origin milk prohibition — each operating independently. Importers who confirm FSSAI licence compliance but overlook the animal-origin AQCS overlay face consignment detention at the designated port; and importers of flavoured or filled confectionery products containing any milk solids sourced from China face outright prohibition under DGFT Notification 01/2015-20 regardless of the FSSAI licence status.
