Other cane or beet sugar, solid form
HSN 1701 99 90 (Other cane or beet sugar in solid form) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence requirements under the Food Safety and Standards Act, 2006, with all import contracts compulsorily registered with the Agricultural and Processed Food Products Export Development Authority (APEDA). Directorate General of Foreign Trade (DGFT) Restricted-import policy under ITC (HS) Chapter 17 and Central Board of Indirect Taxes and Customs (CBIC) customs-clearance overlays apply as additional requirements, and import is permitted only through designated food-import entry points under General Note 4(D) of Schedule I of the ITC (HS) 2022.
- Import Licence from FSSAI
- APEDA contract registration from APEDA
- Specimen copy of label from FSSAI
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a valid FSSAI Import Licence and upload the licence (document code 911001) together with the Specimen Copy of Label (document code 0110FS) in e-Sanchit before filing the bill of entry. The customs proper officer will verify that both documents are uploaded prior to granting out-of-charge.FSSAI Import Licence document code 911001 · Specimen Copy of Label document code 0110FS · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 2Register every import contract for sugar under ITC (HS) code 1701 compulsorily with APEDA before shipment. Unregistered contracts are non-compliant at the bill of entry stage regardless of FSSAI clearance status.APEDA Trade Notice Sugar/Import/01/2019 dated 03-07-2019
- 3Route the consignment through a designated food-import entry point under General Note 4(D) of Schedule I of the ITC (HS) 2022. Confirm that any labelling deficiencies — including per-serve RDA contribution, expiry date, and best-before date — are rectified at the customs bonded warehouse by affixing a single non-detachable sticker next to the principal display panel before inspection by the authorised FSSAI officer.General Note 4(D), ITC (HS) Schedule I, 2022 · CBIC Instruction 10/2022-Cus dated 28-06-2022 · FSSAI clarification order dated 18-11-2022 under F.No.Import/tfm/Apex/2022-FSSAI
The most common error on this tariff line is filing the bill of entry with the FSSAI Import Licence uploaded but the APEDA contract registration absent — APEDA registration is a pre-shipment obligation, and a contract that has not been registered with APEDA before vessel departure cannot be regularised at the port of import. Detention at the designated food-import entry point follows, with demurrage accruing until either regularisation is obtained or the consignment is re-exported.
