Compliance steps
  1. 1
Obtain an FSSAI Import Licence before filing the bill of entry. Upload the licence (document code 911001), a specimen copy of the label (document code 0110FS), and the Phytosanitary Certificate (document code 851000) in e-Sanchit; out-of-charge will not be granted until all three documents are verified.

  2. 2
Route the consignment through a designated food-import entry point in compliance with General Note 4(D) of Schedule I of the ITC (HS) 2022. Consignments arriving at a non-designated port are liable to detention pending re-routing or confiscation.
General Note 4(D) of Schedule I of the ITC (HS) 2022
  3. 3
Ensure the label on each consignment meets the FSS (Labelling and Display) Regulations, 2020 requirements. Rectifiable labelling deficiencies — including per-serve RDA contribution data and expiry date — may be corrected at a customs-bonded warehouse by affixing a single non-detachable sticker without altering the original label, prior to visual inspection by the FSSAI authorised officer.

A word of counsel

The most common error on this tariff line is treating the FSSAI Import Licence as a stand-alone clearance and overlooking the Phytosanitary Certificate requirement (document code 851000), which is independently verified in e-Sanchit before out-of-charge is granted. Where the product is or contains clove stem, testing is assessed against horizontal safety parameters and a volatile oil content of not less than 8.5% by v/w (half the standard for whole cloves under FSSR 2.9.6(1)) — a product-specific criterion that many importers misidentify as the standard clove specification.

Frequently asked
Does HSN 1301 90 99 require BIS certification?
No, natural gums, resins and oleoresins are not within the BIS Quality Control Order regime. Import is governed by the Food Safety and Standards Authority of India under the Food Safety and Standards (Import) Regulations, 2017, with a concurrent Phytosanitary Certificate requirement and designated food-import port restriction under General Note 4(D) of the ITC (HS) 2022.
Which documents must be uploaded in e-Sanchit at the bill of entry stage?
Three documents are mandatory: the FSSAI Import Licence (document code 911001), the Phytosanitary Certificate (document code 851000), and the specimen copy of label (document code 0110FS). All three must be uploaded before the customs proper officer will grant out-of-charge.
Can labelling deficiencies be rectified after arrival, or does non-compliant labelling result in seizure?
Specified labelling deficiencies — including per-serve RDA data and expiry date additions, where provided by the manufacturer — may be rectified at a customs-bonded warehouse before FSSAI inspection by affixing a single non-detachable sticker, per CBIC Instruction 10/2022-Customs and FSSAI order dated 18-11-2022. Non-rectifiable deficiencies remain grounds for detention or re-export.
