Other natural gums, resins, gum-resins and oleoresins
HSN 1301 90 99 (Other natural gums, resins, gum-resins and oleoresins) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards (Import) Regulations, 2017. Phytosanitary clearance and General Note 4(D) designated-port restrictions under the ITC (HS) 2022 policy administered by the Directorate General of Foreign Trade (DGFT) apply as additional clearance requirements.
- Import Licence from FSSAI
- Phytosanitary Certificate from exporting country
- Specimen copy of label from importer
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain an FSSAI Import Licence before filing the bill of entry. Upload the licence (document code 911001), a specimen copy of the label (document code 0110FS), and the Phytosanitary Certificate (document code 851000) in e-Sanchit; out-of-charge will not be granted until all three documents are verified.CBIC Instruction 10/2022-Customs dated 28-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023 · FSSAI order dated 18-11-2022 under F.No.Import/TFM/Apex/2022-FSSAI
- 2Route the consignment through a designated food-import entry point in compliance with General Note 4(D) of Schedule I of the ITC (HS) 2022. Consignments arriving at a non-designated port are liable to detention pending re-routing or confiscation.General Note 4(D) of Schedule I of the ITC (HS) 2022
- 3Ensure the label on each consignment meets the FSS (Labelling and Display) Regulations, 2020 requirements. Rectifiable labelling deficiencies — including per-serve RDA contribution data and expiry date — may be corrected at a customs-bonded warehouse by affixing a single non-detachable sticker without altering the original label, prior to visual inspection by the FSSAI authorised officer.CBIC Instruction 10/2022-Customs dated 28-06-2022, Para 2(i) · FSSAI order dated 18-11-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022
The most common error on this tariff line is treating the FSSAI Import Licence as a stand-alone clearance and overlooking the Phytosanitary Certificate requirement (document code 851000), which is independently verified in e-Sanchit before out-of-charge is granted. Where the product is or contains clove stem, testing is assessed against horizontal safety parameters and a volatile oil content of not less than 8.5% by v/w (half the standard for whole cloves under FSSR 2.9.6(1)) — a product-specific criterion that many importers misidentify as the standard clove specification.
