HSN 1301 90 11 (Asian gum) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006, including the FSS (Import) Regulations, 2017 and FSS (Labelling and Display) Regulations, 2020. Consignments must enter through food-import entry points notified under General Note 4(D) of Schedule I of the ITC (HS) 2022, with Phytosanitary Certificate and specimen label uploaded in e-Sanchit before out-of-charge.
- Import Licence from FSSAI
- Phytosanitary Certificate from exporter
- Specimen copy of label from importer
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a valid FSSAI Import Licence (document code 911001) and upload it in e-Sanchit before filing the bill of entry. The proper officer will verify its presence prior to out-of-charge; bills not routed through FSSAI for NOC will be checked at the officer level.FSSAI Import Licence · document code 911001 · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 2Upload the Phytosanitary Certificate (document code 851000) and a Specimen Copy of Label (document code 0110FS) in e-Sanchit. Label deficiencies permissible for port rectification under FSS (Labelling and Display) Regulations, 2020 — including per-serve RDA contribution and expiry date — must be corrected by affixing a single non-detachable sticker on the principal display panel before visual inspection by the authorised officer.CBIC Instruction 10/2022-Cus dated 28-06-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · FSSAI clarification order dated 18-11-2022
- 3Route the consignment through one of the food-import entry points designated under General Note 4(D) of Schedule I of the ITC (HS) 2022. Diversion to a non-designated port triggers consignment detention pending re-routing or re-export.General Note 4(D) of Schedule I of the ITC (HS) 2022 · CBIC Instruction 05/2023-Cus dated 08-02-2023
The most frequent error on this tariff line is treating label rectification as a blanket remedy for any deficiency. The FSSAI dispensation under CBIC Instruction 10/2022-Cus and the orders of 22-05-2018 and 14-01-2019 covers only the specific items listed — per-serve RDA contribution and expiry/best-before date — and only where the rectification information is furnished by the manufacturer itself and verified by the authorised officer; substantive mislabelling beyond this narrow list results in consignment detention, not rectification.
