The DFIA exclusion for spices is the most frequently overlooked trap on this tariff line: importers holding a DFIA assume the authorisation covers galangal as an industrial or medicinal plant input, but DGFT Policy Circular 05/2025 makes clear that all spices under Appendix 4J are subject to a pre-import condition and are ineligible for DFIA regardless of end use. An import attempted under DFIA will be treated as a policy violation, exposing the consignment to detention and the authorisation-holder to DGFT enforcement. Separately, the rectifiable-labelling dispensation under CBIC Instruction 09/2023-Cus applies only to specified labelling deficiencies — it does not cure a missing FSSAI licence or absent CITES certificate.
