Medicinal, aromatic and insecticidal plants, dried or fresh
HSN 1211 90 29 covers other medicinal, aromatic, and insecticidal plants and plant parts and is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence requirements under the Food Safety and Standards Act, 2006, including the FSS (Import) Regulations, 2017. Consignments are restricted to designated food-import entry points under General Note 4(D) of Schedule I of the ITC (HS) 2022, administered by the Directorate General of Foreign Trade (DGFT) and the Central Board of Indirect Taxes and Customs (CBIC).
- Import Licence from FSSAI
- Specimen copy of label from FSSAI
- Food-import entry point declaration to CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a valid FSSAI Import Licence (document code 911001) and upload it in e-Sanchit before filing the bill of entry. The Specimen Copy of Label (document code 0110FS) must also be uploaded; the proper officer will verify both documents are present before granting out-of-charge.FSSAI Import Licence (document code 911001) · Specimen Copy of Label (document code 0110FS) · CBIC Instruction 10/2022-Customs dated 28-06-2022
- 2Route the consignment only through a designated food-import entry point as required under General Note 4(D) of Schedule I of the ITC (HS) 2022. Label deficiencies may be rectified at customs bonded warehouses before visual inspection by affixing a single non-detachable sticker adjacent to the principal display panel, without altering the original label.General Note 4(D) of Schedule I of the ITC (HS) 2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023 · FSSAI order dated 18-11-2022 under F.No.Import/TFM/APEX/2022-FSSAI
- 3For consignments of clove stem specifically (where no dedicated FSSR standard yet exists), ensure testing against safety parameters under horizontal standards and volatile oil content on a dry basis of not less than 8.5 percent by v/w, as per FSSR 2.9.6(1) applicable to whole cloves.FSSAI order dated 17-06-2022 · Letter No. 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · CBIC Instruction 10/2022-Customs dated 28-06-2022
The most common error on this tariff line is treating minor label deficiencies as a barrier to clearance when FSSAI's rectification dispensation in fact permits correction at the customs bonded warehouse — but only for the specified categories of information and only before visual inspection by the authorised officer. Importers who attempt label rectification after inspection, or who affix detachable stickers over original label content, invalidate the dispensation entirely and expose the consignment to detention. The per-serve RDA contribution and best-before date are rectifiable; missing FSSAI Import Licence or an unapproved entry point are not.
