In-shell groundnuts, H.P.S. grade, not roasted
HSN 1202 41 10 (H.P.S. grade in-shell groundnuts, not roasted or cooked) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006, and the FSS (Import) Regulations, 2017. Consignments must enter only through the designated food-import entry points under General Note 4(D) of Schedule I of the ITC (HS) 2022, administered by the Directorate General of Foreign Trade (DGFT) and Central Board of Indirect Taxes and Customs (CBIC).
- Import Licence from FSSAI
- Specimen copy of label from FSSAI
- Designated-port declaration to CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Secure a current FSSAI Import Licence (document code 911001) and upload it in e-Sanchit before filing the bill of entry. Also upload the Specimen Copy of Label (document code 0110FS); the proper officer must verify both documents are present in e-Sanchit before granting out-of-charge.FSSAI Import Licence · document codes 911001 and 0110FS · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 2Route the consignment only through the designated food-import entry points notified under General Note 4(D) of Schedule I of the ITC (HS) 2022. Arrival at an undesignated port renders the consignment liable to detention pending re-routing or re-export.General Note 4(D), Schedule I, ITC (HS) 2022 · CBIC Instruction 05/2023-Cus dated 08-02-2023
- 3Ensure labels comply with FSS (Labelling and Display) Regulations, 2020. Rectifiable labelling deficiencies — including per-serve RDA contributions and expiry date — may be corrected at customs bonded warehouses by affixing a single non-detachable sticker before visual inspection, without altering the original label; non-rectifiable deficiencies trigger rejection or re-export.CBIC Instruction 10/2022-Cus dated 28-06-2022 · FSSAI order dated 18-11-2022 under F.No.Import/TFM/Apex/2022-FSSAI · CBIC Instruction 09/2023-Cus dated 07-03-2023
The most common error on this tariff line is treating any labelling deficiency as automatically rectifiable at port. The CBIC Instruction 10/2022-Cus and the FSSAI clarification order dated 18-11-2022 define a closed list of rectifiable particulars — per-serve RDA percentages and expiry/best-before dates — that may be corrected by sticker before inspection; all other labelling deficiencies constitute non-rectifiable violations triggering FSSAI rejection, consignment detention, and ground rent accumulation, with no sticker remedy available.
