HSN 1008 29 40 (Barnyard millet) is subject to Food Safety and Standards Authority of India (FSSAI) import clearance under the Food Safety and Standards Act, 2006, including compliance with the FSS (Import) Regulations, 2017 and FSS (Labelling and Display) Regulations, 2020. The tariff line is also subject to ITC (HS) policy controls administered by the Directorate General of Foreign Trade (DGFT), and consignments may be imported only through the 79 designated food-import entry points under General Note 4(D) of Schedule I of the ITC (HS) 2022.
- Import Licence from FSSAI
- Compliant label from importer
- ITC (HS) entry-point declaration to CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Ensure the consignment arrives at one of the 79 designated food-import entry points listed in the ITC (HS) 2022 Schedule I annexure. Import of food articles at non-designated ports violates General Note 4(D) of Schedule I of the ITC (HS) 2022 and attracts detention and re-export.General Note 4(D) of Schedule I of the ITC (HS) 2022 · CBIC Instruction 05/2023-Cus dated 08-02-2023
- 2Verify that all label information required under the FSS (Labelling and Display) Regulations, 2020 is present on the principal display panel before shipment. Where permissible labelling deficiencies exist — including per-serve percentage RDA contribution and expiry date — rectification must be carried out at a customs-bound warehouse by the importer, by affixing a single non-detachable sticker without altering the original label.CBIC Instruction 10/2022-Customs dated 28-06-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 3Upload all mandatory FSSAI import-clearance documents in e-Sanchit before the bill of entry is filed. The authorised officer or representative will conduct visual inspection or re-inspection after in-warehouse label rectification; out-of-charge will not be granted until FSSAI clearance is verified.FSS (Import) Regulations, 2017 · FSSAI clarification order dated 18-11-2022 under F.No.Import/TFM/Apex/2022-FSSAI · CBIC Instruction 09/2023-Cus dated 07-03-2023
The single most common error on cereal imports under this tariff line is assuming that label rectification at port is an unconditional right. The dispensation under CBIC Instruction 10/2022-Customs and the FSSAI order dated 18 November 2022 applies only to specified permissible deficiencies — notably per-serve RDA contribution and expiry date — and only where the corrected information originates from the manufacturer itself. Importers who attempt to rectify substantive nutritional or origin labelling errors via stickering face rejection of the rectification and detention of the consignment pending re-export or destruction.
