Yellow
Yellow maize (corn) for food import
HSN 1005 90 11 (Yellow maize) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006, including the FSS (Import) Regulations, 2017 and FSS (Labelling and Display) Regulations, 2020. The Directorate General of Foreign Trade (DGFT) administers the ITC (HS) import policy, and consignments must enter only through designated food-import ports per General Note 4(D) of Schedule I of the ITC (HS) 2022.
- Import Licence from FSSAI
- Specimen copy of label from FSSAI
- Food-import entry-point declaration to CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain the FSSAI Import Licence and upload it in e-Sanchit under document code 911001 before filing the bill of entry. Also upload the Specimen Copy of Label (document code 0110FS); customs out-of-charge will not be granted until both documents are verified in e-Sanchit.CBIC Instruction 09/2023-Cus dated 07-03-2023 · CBIC Instruction 10/2022-Cus dated 28-06-2022 · FSSAI order dated 18-11-2022 under F.No.Import/TFM/APEX/2022-FSSAI
- 2Route the consignment only through a designated food-import entry point in compliance with General Note 4(D) of Schedule I of the ITC (HS) 2022. Arrival at a non-designated port renders the consignment liable to detention pending re-routing or confiscation.General Note 4(D) of Schedule I of the ITC (HS) 2022
- 3Rectify any labelling deficiencies — including per-serve percentage contribution to recommended dietary allowance, and date of expiry alongside best-before date — at the customs bonded warehouse before FSSAI visual inspection, by affixing a single non-detachable sticker next to the principal display panel without altering the original label. The rectification window is defined by Regulation 6 of the FSS (Import) Regulations, 2017 and the CBIC Instruction 10/2022-Cus framework.CBIC Instruction 10/2022-Cus dated 28-06-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · FSS (Labelling and Display) Regulations, 2020
The most common error on this tariff line is assuming that a labelling deficiency can be corrected after FSSAI visual inspection has been initiated. The rectification dispensation under CBIC Instruction 10/2022-Cus applies only before the authorised officer's inspection, and only via a single non-detachable sticker affixed at a customs bonded warehouse; any alteration after inspection commences, or any detachable sticker, is treated as a labelling violation under the FSS (Import) Regulations, 2017, exposing the consignment to rejection and re-export.
