Powder
Ground ginger powder, crushed or ground spices
HSN 0910 12 10 (ground ginger powder) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and food-safety clearance under the Food Safety and Standards Act, 2006, with a minimum 25% value-addition condition under ITC (HS) Chapter 9 policy administered by the Directorate General of Foreign Trade (DGFT). Consignments must transit only through designated food-import ports per General Note 4(D) of Schedule I of the ITC (HS) 2022, and spices under this tariff line are ineligible for import under DFIA irrespective of intended end use.
- Import Licence from FSSAI
- Food grade certificate from FSSAI
- Phytosanitary Certificate from exporter
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a valid FSSAI Import Licence and ensure the foreign manufacturing facility meets FSSAI food-safety requirements. Before filing the bill of entry, upload in e-Sanchit the FSSAI Import Licence (document code 911001), Specimen Copy of Label (document code 0110FS), Food Grade Certificate (document code 6570FS), and Phytosanitary Certificate (document code 851000).FSSAI Import Licence · CBIC Instruction 09/2023-Cus dated 07-03-2023; CBIC Instruction 10/2022-Cus dated 28-06-2022
- 2Confirm the consignment satisfies the minimum 25% value-addition condition under ITC (HS) Chapter 9 policy before shipping. Additionally, verify that the import is not being attempted under a Duty-Free Import Authorisation — all spices fall under Appendix 4J and are subject to a pre-import condition, making DFIA import impermissible under any circumstances.DGFT Public Notice 08/2024-25 dated 03-06-2024; DGFT Policy Circular 05/2025 dated 22-09-2025
- 3Route the consignment through one of the 79 designated food-import entry points per General Note 4(D) of Schedule I of the ITC (HS) 2022. Labelling deficiencies permissible for rectification under FSS (Labelling and Display) Regulations, 2020 must be corrected at a customs bonded warehouse before visual inspection, using a single non-detachable sticker affixed next to the principal display panel.CBIC Instruction 10/2022-Cus dated 28-06-2022; FSSAI order dated 18-11-2022 under F.No.Import/TFM/Apex/2022-FSSAI
The most prevalent error on this tariff line is attempting to import ground ginger or other spices under a Duty-Free Import Authorisation on the assumption that an export-linked end use creates an exemption. DGFT Policy Circular 05/2025 dated 22-09-2025 explicitly closes this route: all spices in Appendix 4J carry a pre-import condition and DFIA import is not permissible irrespective of intended end use. A consignment presented under DFIA will face detention and may be directed for re-export.
